By purchasing, you confirm that you will use these products only for their intended research purposes and in compliance with all applicable laws and safety regulations.

2. Eligibility and Account Creation

To use this Site or purchase products, you must be at least 18 years old and legally capable of entering a binding contract.

ALL PRODUCTS ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.” TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY;
  • IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE;
  • WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE; AND
  • ANY WARRANTIES REGARDING RESULTS OBTAINED FROM USE OF THE PRODUCTS.

No oral or written information provided by the Company shall create any warranty not expressly stated herein.

Assumption of Risk

You acknowledge that research compounds may present inherent risks. You assume full responsibility for the proper handling, storage, testing, use, and disposal of all products purchased. You further assume all risks associated with misuse, improper handling, regulatory non-compliance, or use inconsistent with labeled research purposes.

Limitation of Liability

To the fullest extent permitted by law, the Company’s total cumulative liability arising out of or relating to any product purchased or use of the Site shall not exceed the total purchase price paid for the specific product giving rise to the claim.

Under no circumstances shall the Company be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, business interruption, personal injury, or property damage, even if advised of the possibility of such damages.

Nothing in these Terms shall exclude liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

4. Use of Site

By using our Site, you agree to:

  • Use products only for legitimate research purposes.
  • Comply with all applicable handling, storage, and disposal regulations.
  • Not resell or distribute products for non-research purposes.

5. Shipping & International Orders

  • You are responsible for complying with all import, customs, and regulatory requirements in your country.
  • You accept responsibility for any seized shipments or regulatory delays.
  • We are not liable for customs issues, fees, or international shipping delays.

6. Indemnification

You agree to indemnify, defend, and hold harmless Peak Lab Peptides LLC, its officers, employees, and affiliates from any claims, losses, or damages (including attorney fees) resulting from your misuse of products or violation of these Terms.

7. Intellectual Property

All content on this Site—including text, graphics, logos, product names, and images—is the property of Peak Lab Peptides LLC or its licensors and protected under applicable copyright and trademark laws.

8. Order Acceptance & Cancellation

We reserve the right to cancel or refuse orders at our discretion for reasons including, but not limited to:

  • Suspected fraud or misuse.
  • Regulatory restrictions on certain products.
  • Security concerns or data errors.

9. Governing Law; Binding Arbitration; Class Action Waiver

These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law principles. The Federal Arbitration Act (“FAA”) governs the interpretation and enforcement of the arbitration provisions below.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any products purchased from the Company (including tort, statutory, fraud, misrepresentation, or product liability claims) shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place on an individual basis and may be conducted remotely or in a mutually agreed location. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration provision.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be conducted solely on an individual basis and not as part of a class, consolidated, representative, collective, or private attorney general action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

Jury Trial Waiver

To the fullest extent permitted by law, you waive any right to a jury trial for any dispute covered by this Section.

Small Claims Exception

Either party may bring an individual action in small claims court if the claim qualifies and remains on an individual basis.

30-Day Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to the Company within thirty (30) days of first accepting these Terms. The notice must include your full name, address, and a clear statement that you wish to opt out of arbitration.

10. Privacy Policy

Your use of this Site is also governed by our Privacy Policy, which explains how we collect and protect your data.

11. Modifications

Peak Lab Peptides LLC may modify these Terms at any time. Updated Terms will be posted here with a new effective date. Continued use of the Site signifies your acceptance of any changes.

12. Peak Lab Credit Program

The Company offers a limited-time promotional account credit incentive program (the “Peak Lab Credit Program”) to eligible customers who submit payment for an order through an approved third-party peer-to-peer payment platform, such as Zelle® or Venmo® (each, a “P2P Platform”).

Issuance of Peak Lab Credit

Eligible customers will receive a promotional credit equal to five percent (5%) of the total amount of a qualifying order paid through an approved P2P Platform (the “Peak Lab Credit”). For purposes of this program, “order total” means the final amount charged and successfully received by the Company for the transaction.

For customers with registered accounts, Peak Lab Credit is issued automatically upon confirmed receipt and verification of payment. Guest customers may be required to create an account in order to access or redeem issued credits. Credits issued to guest customers may remain pending for up to seven (7) days; unclaimed pending credits will automatically expire and be forfeited.

Issuance of Peak Lab Credit is conditioned upon the Company’s verification that the underlying payment has been successfully completed and is not subject to reversal, dispute, fraud concern, or other irregularity.

Promotional Nature; No Cash Value

Peak Lab Credit is a conditional promotional discount offered at the Company’s discretion. It:

Is not cash, currency, legal tender, stored value, prepaid access, a gift card, deposit account, rebate, or financial product;

Has no cash value;

Is not redeemable or exchangeable for cash or cash equivalents;

Is not transferable, assignable, or resalable; and

Does not constitute property, a vested right, or an enforceable financial obligation.

Peak Lab Credit exists solely as a promotional discount that may be applied to a future qualifying purchase on the Company’s website, subject to these Terms.

Redemption Restrictions

Peak Lab Credit:

May only be applied toward a future purchase on the Company’s website;

May not be applied to prior purchases;

May not be applied to shipping fees, subscriptions, taxes, or other excluded items unless expressly stated by the Company;

May not be combined with other promotions, discounts, or offers unless expressly permitted; and

Is applied at checkout in accordance with the Company’s then-current redemption procedures.

Credits may be accumulated across multiple qualifying transactions but must be redeemed prior to expiration.

Expiration

Peak Lab Credit expires ninety (90) days from the date of issuance. Expired credits are automatically forfeited and have no value.

The Company intends Peak Lab Credit to qualify as a short-term promotional discount. If any state law is deemed to require a longer validity period for promotional credits, the credit will remain valid only for the minimum period required by applicable law in that jurisdiction.

Payment Reversals and Fraud

If a payment made through a P2P Platform is reversed, disputed, refunded, charged back, flagged as unauthorized, or otherwise not finally settled for any reason, the Company reserves the right to:

Withhold, cancel, revoke, or adjust any associated Peak Lab Credit;

Deduct the equivalent value of redeemed credits from the customer’s account;

Offset amounts against future transactions; and/or

Suspend or terminate the associated customer account.

Customers are solely responsible for complying with the terms of any P2P Platform used. The Company is not responsible for payment errors, misdirected transfers, platform outages, or actions taken by any P2P Platform.

Zelle® and Venmo® are registered trademarks of their respective owners. The Company is not affiliated with, endorsed by, or sponsored by any P2P Platform.

No Fiduciary or Banking Relationship

Peak Lab Credit does not represent funds held on behalf of any customer and does not create any fiduciary duty, trust relationship, escrow obligation, banking relationship, or money transmission obligation. Credits do not accrue interest and are not insured or guaranteed by any governmental or financial institution.

Program Modification or Termination

The Company reserves the right to modify, suspend, or terminate the Peak Lab Credit Program at any time in its sole discretion. Changes will apply prospectively. The Company may revoke unused credits upon termination of the program, subject to applicable law.

Abuse; Discretion

The Company reserves the right to withhold, cancel, or revoke Peak Lab Credit in cases of suspected fraud, abuse, duplicate transactions, account manipulation, policy violations, or other misuse of the program.

Eligibility determinations and credit calculations are made in the Company’s reasonable discretion following manual or automated review.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company’s total liability arising out of or relating to the Peak Lab Credit Program shall not exceed the unused Peak Lab Credit balance associated with the customer’s account at the time the claim arises.

The Company shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in, modification of, suspension of, or termination of the program.

Participation in the Peak Lab Credit Program constitutes acceptance of these Terms and the Company’s general Terms and Conditions.

13. Regulatory Compliance; No Medical Claims

The products offered by Peak Lab Peptides LLC are not approved by the U.S. Food and Drug Administration (FDA) for human or veterinary use. The Company does not make any claims regarding therapeutic benefit, medical efficacy, safety for consumption, or suitability for clinical application.

Any references to scientific studies or research publications are provided for informational purposes only and do not constitute claims that the products are safe, effective, or approved for any specific use.

The Company does not provide dosage instructions, medical advice, treatment recommendations, or guidance for human or animal administration. Customers are solely responsible for ensuring that products are used strictly for lawful laboratory research purposes.

The Company reserves the right to refuse service to any customer suspected of purchasing products for purposes inconsistent with labeled research use.

14. Entire Agreement

These Terms, along with our Privacy Policy, Peak Lab Credit Program Terms, and other posted legal notices, form the entire agreement between you and Peak Lab Peptides LLC. If any provision is deemed unenforceable, the remaining sections remain in full effect.
