10.  Binding Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Disclaimer, your purchase, or your use of the Website (a “Dispute”) shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court where permitted.

  • The arbitration shall be administered under the rules of a mutually agreed arbitration organization, conducted in South Dakota, and governed by the Federal Arbitration Act.
  • YOU AND PEAK LAB PEPTIDES EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Disputes must be brought in an individual capacity only.
  • Each party bears its own costs of arbitration except as otherwise required by applicable law.
  • If any portion of this arbitration provision is found unenforceable, the remainder shall remain in full force and effect.

11.  Governing Law and Venue

This Disclaimer, the arbitration provisions in Section 10, and any Dispute — regardless of the purchaser’s state or country of residence, domicile, or place of business — shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to South Dakota’s or any other jurisdiction’s conflict-of-laws principles, and without regard to the Uniform Commercial Code or consumer-protection statutes of any other state. You expressly agree that your state or country of residence has no application to this Disclaimer or any Dispute, notwithstanding any general or local law to the contrary. Subject to Section 10, exclusive venue for any permitted court proceeding shall lie in the state or federal courts located in South Dakota, and you irrevocably consent to personal jurisdiction therein and waive any objection to venue or forum non conveniens.

12.  Export Control and Compliance

You agree to comply with all applicable U.S. export control and economic sanctions laws and regulations. You represent that you are not located in, and will not export, re-export, or transfer any product to, any country, entity, or individual subject to U.S. export restrictions or sanctions, and that you are not on any restricted party list maintained by the U.S. government.

13.  Severability; No Waiver; Entire Agreement

If any provision of this Disclaimer is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that or any other provision. This Disclaimer, together with our Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and Peak Lab Peptides regarding the subject matter herein and supersedes all prior agreements or understandings, whether written or oral.
